The website https://phocus1.com (hereinafter the “Website”) is published and operated in accordance with the European regulations in force governing information society services, data transparency and consumer protection.

Connecting to, browsing and using the Website imply the User’s (hereinafter the “User”) full and unreserved acceptance of this legal notice and these general terms of use.

ARTICLE 1 – THE PUBLISHER

ARTICLE 2 – THE HOSTING PROVIDER

The Website is hosted by OVH SAS, whose registered office is located at 2 rue Kellermann, 59100 Roubaix, France.

ARTICLE 3 – ACCESS TO THE WEBSITE

The Website is accessible from any location, 7 days a week, 24 hours a day, except in cases of force majeure or of scheduled or unscheduled interruptions that may result from technical maintenance requirements. In the event of any modification, interruption or suspension of the Website, the Publisher shall not be held liable for any direct or indirect damage whatsoever.

ARTICLE 4 – NATURE OF THE INFORMATION AND LEGAL WARNING (AIF DISCLOSURE)

PHOCUS1 is an Alternative Investment Fund (AIF). Accordingly, the User’s attention is specifically drawn to the restrictive nature of the information published on this Website:

  • No contractual or legal value: No information, data, analysis, study, chart or simulation published on this Website constitutes financial, legal, regulatory, accounting, tax or contractual information.
  • No advice and no offer: The content of the Website is provided purely for information and general presentation purposes. It does not under any circumstances constitute an offer to buy, a solicitation to sell, an inducement to invest or personalised financial advice.
  • Accuracy and reliability of data: Although the Publisher endeavours to publish accurate information, any data on the Website may contain inaccuracies or omissions, or may be incorrect. The Publisher accepts no liability for any use or interpretation that may be made of such information. The User must under no circumstances rely on the content of the Website to make investment decisions or commit funds.

ARTICLE 5 – PRIVATE PLATFORM AND PROSPECTING DATA

The Website provides access to a dedicated area and a registration platform for investors and prospects, available at https://private.phocus1.com (hereinafter the “Private Platform”), which allows users to register and collects their contact details and address data.

  • Non-contractual nature of the figures displayed: All figures, returns, simulations, past performance and indicators displayed on the Private Platform are provided strictly for information purposes and have no contractual or definitive value. Past performance is in no way indicative of future performance.
  • Risk of IT errors and transcription errors: As a web infrastructure and technology tool, transcription errors, omissions, display delays, outages or software bugs may alter or distort the accuracy of the figures and data displayed. The Publisher shall not be held liable for the consequences of such technical failures.
  • Sole official reference: For any official data, certified financial calculation, accounting statement or definitive position, Users and investors must refer exclusively to the official documents issued directly by the official Luxembourg fiduciary of PHOCUS1, namely FISCONSULT S.A., located at 11 Rue Glesener, L-1631 Luxembourg, and reachable by telephone on +352 26 89 08. Only data transmitted and certified by Fisconsult are authoritative and enforceable.

ARTICLE 6 – PERSONAL DATA PROTECTION (GDPR)

The Publisher undertakes that the collection and processing of the User’s personal data (in particular upon registration on the Private Platform, during our direct exchanges or via the Website’s contact form) comply strictly with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).

  • Data collected: Last name, first name, email address, telephone number, company name, connection data.
  • Purposes of processing: Handling and follow-up of contact or information requests, management of access and registrations on the Private Platform (https://private.phocus1.com), legitimate commercial prospecting, advertising targeting (in particular via third-party advertising platforms such as Google Ads), and overall improvement of our services and marketing campaigns.
  • Legal bases: This processing is carried out exclusively on the basis of your explicit consent or of our legitimate interest in developing our business.
  • Retention period: Personal data are retained for a maximum of 3 years from the User’s last contact or from the end of the business relationship.
  • Transfers outside the European Union: Where third-party analytics or advertising tools are used (e.g. Google Ads), certain data flows may be transferred outside the European Union. Such transfers are always subject to the appropriate legal safeguards required by the GDPR (in particular the European Commission’s standard contractual clauses).
